Registre des entreprises non admissibles aux contrats publics

The registre des entreprises non admissibles aux contrats publics is Quebec’s official register of companies ineligible for public contracts. It is maintained by the Autorité des marchés publics (AMPS) under the Loi sur les contrats des organismes publics (LCOP, chapter C-65.1), and it is the list Quebec public bodies must check before awarding any contract covered by the law.

What it is

Per the LCOP, the AMPS “tient un registre des entreprises non admissibles aux contrats publics” — keeps the register of enterprises ineligible for public contracts — and must record in it the required information for each ineligible enterprise (section 21.7). An enterprise that is ineligible cannot, for the duration of its ineligibility, submit a bid for a public contract, conclude one, or conclude a public subcontract (section 21.5.5).

How a company lands on the register

Per the statute, an enterprise that is convicted, by final judgment, of an offence listed in Schedule I of the LCOP becomes ineligible for public contracts for 5 years from the moment the conviction is recorded in the register. The same 5-year bar applies to an enterprise linked to a convicted person, and to a legal person controlled by an ineligible enterprise — including one holding at least 50% of the voting rights. Ineligibility can also result from a decision of the AMPS under the Act’s other provisions (sections 21.3–21.4). While a company can regain eligibility by registering in the register of authorized enterprises (registre des entreprises autorisées), ineligibility otherwise runs for the statutory period.

Common questions

Is this the same as the federal Integrity Regime?

No — separate legal regimes. Quebec’s register operates under the LCOP and the AMPS; the federal Integrity Regime is administered by PSPC under federal policy. A supplier can be on both, and public bodies check the list applicable to their own contracts.

What must Quebec public bodies check before award?

Under the LCOP framework, public organisms must verify a bidder’s authorization to contract and eligibility — which means consulting the AMPS registers. See the Autorité des marchés publics, the LCOP, and the federal analogue supplier suspension and debarment.
