Responsive bid
A responsive bid is a bid that complies with all the requirements of the bid solicitation and meets every mandatory evaluation criterion. Only responsive bids are ranked or compared; a bid that misses any mandatory requirement is declared non-responsive and is not considered further.
The two-part test
In federal practice, a bid is declared responsive only if it (a) complies with the requirements of the bid solicitation as issued, and (b) meets all mandatory criteria — the pass/fail requirements. The treatment of mandatory requirements is absolute: failure on a single one renders the bid non-responsive, regardless of price or technical merit. Non-responsive bids receive no further evaluation.
How it works in evaluation
Evaluation proceeds in sequence: mandatory requirements first, then point-rated technical criteria and financial evaluation for the bids that survive. A bid can be responsive and still lose — responsiveness is about compliance, not winning. The distinction matters in debriefs too: unsuccessful bidders are told separately whether their bid was responsive but not highest-ranked, or non-responsive because it missed a mandatory requirement.
Common questions
Is a responsive bid the same as a compliant bid?
In practice the terms are used interchangeably in Canada; "responsive" is the term the federal Supply Manual and most solicitation documents use for a bid that meets all requirements and mandatory criteria.
Can a buyer waive a missing mandatory item?
No. Mandatory requirements are absolute; accepting a bid that fails one exposes the award to a bid challenge. If a missing item is significant, some buyers permit clarification within the solicitation's stated rules — but a substantive deviation makes the bid non-responsive.
What happens when only one bid is responsive?
The buyer proceeds with that bid but must justify price reasonableness — the federal Supply Manual has specific procedures for one responsive bid and for no responsive bids received.
